Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your use of Linda (the "Service"), operated by Phoenix Rising AI ("we", "us", "our") at asklindaai.com, including our website, apps, phone line, and text messaging. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to use the Service. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. If you use the Service on behalf of an organization, you confirm you are authorized to accept these Terms for it.

3. Linda is an AI, not a professional

Linda is an artificial intelligence. Its responses are generated automatically and may be inaccurate, incomplete, or inappropriate. Linda does not provide medical, mental health, legal, or financial advice, and is not a substitute for a qualified professional or a human caregiver.

Linda is not an emergency service. If you or someone else is in danger, call 911 or your local emergency number. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline, US).

4. Acceptable use

You agree not to:

• use the Service for anything illegal, harmful, harassing, or fraudulent;
• impersonate others or use the Service to contact people without their consent;
• attempt to access accounts or data that are not yours, or disrupt the Service;
• reverse engineer, scrape, or resell the Service without our written permission;
• use the Service to generate content that exploits minors or promotes violence.

We may suspend or terminate accounts that violate these rules.

5. Your content

You keep ownership of the messages, voice recordings, and other content you share with Linda. You give us a limited license to store, process, and use that content only as needed to operate and improve the Service for you, as described in our Privacy Policy. You are responsible for having the right to share any content you provide.

6. Connected accounts and third-party services

If you connect accounts such as Google (Gmail or Google Calendar), you authorize Linda to access them to perform the actions you request. You can disconnect them at any time. The Service relies on third-party providers, and we are not responsible for their services or terms.

7. Calls and text messages

By providing your phone number and opting in, you agree to receive calls and text messages from Linda related to the Service. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Calls may be recorded and transcribed to provide the Service.

8. Free trials, subscriptions, and billing

Some plans include a free trial. Unless you cancel before the trial ends, your subscription will begin and you will be charged the plan price. Subscriptions renew automatically each billing period until canceled. You can cancel at any time and your access continues until the end of the current period. Payments are processed by Stripe. Except where required by law, fees are non-refundable. We may change prices with advance notice.

9. Our intellectual property

The Service, including the Linda name, software, design, and content we provide, is owned by Phoenix Rising AI and protected by law. We grant you a personal, non-exclusive, non-transferable right to use the Service under these Terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any reminder, call, or message will be delivered.

11. Limitation of liability

To the fullest extent permitted by law, Phoenix Rising AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Phoenix Rising AI is organized, without regard to conflict-of-law rules.
